TERMS AND CONDITIONS FOR PURCHASES OF MEMBERSHIP, PRODUCTS AND SERVICES

The Canadian Antique & Classic Boat Society doing business as The Antique & Classic Boat Society – Toronto and ACBS - Toronto (collectively ACBS) is committed to respecting the privacy of individuals and recognizes the needs of people with whom we do business, our members, supporters and suppliers, for the appropriate management and protection of any personal information that such individuals agree to provide to ACBS.

Purpose of Information Collection: ACBS collects personal information from its members for the purpose of quantifying its membership, providing communication to individual members, and affecting the renewal process. ACBS collects personal information from its supporters and suppliers where necessary to meet the requirements of the contract of goods and services with such supporters and suppliers (e.g. advertisers) and to affect the respective billing and payment processes.

Information Collected: The following information will be collected from members, supporters and suppliers.

Unless otherwise specified, this is the only personal information that will be collected and this information will only be accepted from the individual it relates to unless otherwise authorized by that individual. An individual can request that one or more items of personal information not be provided as long as there is sufficient information to be able to contact the individual. ACBS will retain a record of how the information was collected (i.e.: event, renewal form, website) to substantiate source.


Disclosure: ACBS’s mailing list is confidential and available only to members through the printed or electronic directory. The directory is provided for the exclusive use of members and may not be used for business solicitation or any other commercial purpose not related to ACBS business or activities. This information is included in the Members Only section on the acbs.ca website with password protection. ACBS directors, officers, and members are bound by this privacy policy and are required to appropriately secure such personal information.


ACBS does not rent, sell, or trade mailing lists. Personal contact information supplied to ACBS (e.g. postal address, e-mail address, telephone number) on-line or by registration through the membership chair or others designated to collect membership information at events, will be used exclusively by ACBS.


ACBS strives to protect the privacy of those who visit, browse, and use the acbs.ca website. The ACBS web server does not use tracking cookies or recognize any personal information regarding the identity or e-mail address of visitors to the Site, and does not collect unsolicited identifying information about those who access the Site. Information communicated to members by way of e-mail communications will not include a list of the e-mail addresses of the members receiving the communication.

Members wishing to be removed from the ACBS member’s list should contact the membership chairperson at membership@acbs.ca or via mail at 2528 Bayview Avenue, P.O. Box 35529, North York, Ontario M2L 2Y4. All requests will be accommodated promptly.


Members receiving copies of the directory are expected to maintain current directories in a place where they cannot be accessed by non-members. Electronic copies should be password protected.

Retention and Destruction of Personal Information: The membership chairperson is responsible for the ultimate collection, retention, and destruction of personal information. Anyone who collects personal information on behalf of ACBS is to destroy any documents showing the collection of personal information once the information has been provided to the membership chairperson. Any membership listings that are given to directors, officers, and volunteers to conduct society business are to be destroyed when updated listings are provided. The membership chairperson will retain the master listing in accordance with statutory requirements or where necessary for business decision purposes. When personal information reaches the end of the retention period, the personal information will be destroyed using acceptable methods that will eliminate the possibility of recreating the information. Acceptable methods could be shredding or incinerating the information or deleting files from electronic devices but are not limited to such. Paper and electronic copies of the directory will contain statements to members concerning the disclosure, retention, and destruction of the directory.

Members receiving copies of the directory are expected to destroy outdated copies of the directory once they receive updates. Electronic copies of the directory should be password protected and outdated file copies should be deleted when updates are received.

Information Security: Personal information collected and/or stored on an electronic device will be password protected. Personal information in hard copy will be appropriately secured so that access is only available to the individual(s) intended as outlined in this policy. Personal and sensitive information that may be contained in the society’s website will be limited to Members Only access.

Disclosure: Unless otherwise stated, no personal information will be disclosed to any party other than those specifically named in the ACBS Privacy Policy. Should a request to provide personal information to any third party be made, such a request will be reviewed with the membership before any information will be disclosed. Individual members may decline disclosure unless there is a statutory requirement to do so.

ACBS may use third party data collection organizations in foreign jurisdictions to process personal information. The Personal Information Protection and Electronic Documents Act (PIPEDA) does not prohibit organizations in Canada from transferring personal information to an organization in another jurisdiction for processing. A transfer for processing is a use of the information and not a disclosure so does not require consent for the transfer as long as the information is being used for the purpose for which it was originally intended. ACBS is still accountable for the information in the hands of the processing organization and must ensure that such protection exists. ACBS will only engage the use of a data collection organization that provides ACBS with assurance that the information will be secured and only used for the purposes intended by ACBS. This assurance will be enforced through contract. Since PIPEDA requires organizations to be transparent about their personal information handling practices, ACBS will inform its members and any other parties to which they collect personal information that such information may be sent to another jurisdiction for processing and that while that information is in another jurisdiction it may be accessed by the courts, law enforcement, and national security authorities. Examples of such situations would be the use of Adobe software to collect such personal information and the collection of such personal information for ACBS International for ACBS International member registrations. It should be known that the USA Patriot Act allows U.S. officials to access personal information about Canadian citizens if that information is physically within the United States.

Online Transactions and Credit Card Security:

ACBS has established a brand and a level of confidence with its members and interested publics which could be severely compromised if there was a data breach. A policy and accompanying standards and procedures is in existence to minimize the exposure of such a compromise.

ACBS is committed to the protection of credit card information when members pay for membership, products and services. Policies and practices have been developed following the guidelines developed by the PCI Security Standards Council. The PCI Security Standards Council has developed a set of comprehensive data security standards (PCI DSS) for enhancing payment account data security. The underlying factor for these standards is the elimination of fraud and the compromise of credit card information. The core of the PCI DSS is a group of principles and accompanying requirements around which the specific elements of the DSS are organized. All orders and purchases through the Members Only section of the website are in Canadian funds. You agree to pay for all charges noted as payable by you. While ACBS takes great care to ensure its prices and advertising are accurate, errors or inaccuracies may occur. ACBS may correct errors or inaccuracies and change or update information in the Members Only section of the website at any time without notice and may, at its discretion, request additional funds or refund overpayments resulting from inaccuracies. If you agree to forward payment by cheque or other means upon membership renewal, purchase, or registration, you are subject, at the discretion of ACBS, to any additional costs to process the payment should there by a default.

If the transaction is for a purchase of an item or to register for an event, there may be limitations on availability which will either prevent the transaction from being processed or will result in a refund upon notification. ACBS reserves the right to limit transactions at it sole discretion without recourse of any kind.
